Member Data
The Asociación only holds data provided by the Member from the initial membership form or subsequent updates to this data. This data is necessary to provide the member with membership benefits in exchange for the membership subscription. The “data” is:
- Member household identity: Street address + owner/renter
- Member household payments: Subscription amount and date.
- Member household contact: Name + email address
- Additional optional data supplied by the member on the application form which may be used by the secretariat to assist members e.g. in the case of misdirected mail.
Data Protection Procedures
The data is used solely for purposes in connection with running the Asociación
We do not provide any of the data to 3rd parties nor to other Members without the Member’s explicit agreement.
The data is held in the Membership Database which is password protected.
Email addreses are also stored in the email message forum hosted on Google servers.
Access to the data is restricted to Asociación administrative staff who administer this data.
Member rights
By law, members have a number of rights when it comes to their personal data. Further information and advice about these rights can be obtained from the data protection regulator in Spain.
Appendix. Legitimate Interest Assessment
Introduction
La Asociación de Gata Residencial is a not for profit organisation registered in Alicante as having its own legal personality. Membership is entirely voluntary.
The Three Tests
- Purpose test: are you pursuing a legitimate interest?
The Asociación unites residents of the Gata Residencial urbanisation with the aim of improving the quality of life of its members.
Therefore, we are pursuing a legitimate interest that is shared with the membership with whom we communicate and who are the beneficiaries of our activities.
- Necessity test: is the processing necessary for that purpose?
Member data is processed solely for the purposes of:
- Administration of membership.
- Communications between the committee and individual members.
- Communication between individual members and the group as a whole. However individual members may opt out of this channel of communication.
- Balancing test: do the individual’s interests override the legitimate interest?
Member data is only processed for purposes strictly necessary to the aims of the Asociación therefore there is no conflict of interest.
Conclusion
La Asociación de Gata Residencial is pursuing a legitimate interest, which is shared by the membership. It undertakes limited processing of personal data to facilitate communication with the membership and because of the voluntary engagement of the membership in a shared activity no member interests override the legitimate interest of the organisation.
